بنا به نظر دبیر اجرایی كمیسیون اقتصادی آمریكای لاتین و كشورهای حوزه كارائیب 'آلیشیا بارسنا'، با وجود تداوم بی ثباتی در بازارهای مالی جهان، اقتصاد كشورهای آمریكای لاتین و منطقه كارائیب در سال 2011، سهم قابل توجهی سرمایه خارجی جذب كرد كه در طول سال 2012 روند صعودی خود را حفظ خواهد كرد.

ضمن ارسال یك نسخه مصوبه مجلس شورای اسلامی تحت عنوان 'قانون نظارت مجلس بر رفتار نمایندگان' واصله به شماره 474.4985 مورخ 91.2.9 و صرف نظر از میزان كارآمدی و یا سایر وجوه مصوبه مذكور به استحضار می‌رساند تبصره 1 ماده 9 كه تشخیص مصادیق اصل 86 قانون را به عهده هیاتی از نمایندگان مجلس قرار داده، آشكارا مخالف اصول متعدد قانون اساسی است چرا كه طبق قواعد شناخته شده، اگر نماینده‌ای در اظهارنظر خود، حقوق دیگران را نقض كند و یا مرتكب توهین یا تهمت یا افترا شود، این امر قابل رسیدگی در مرجع قضایی است.

در تبصره 2 مصوبه فوق علاوه بر دادن اختیار انحصاری رسیدگی به اظهارنظرها به هیاتی از نمایندگان مجلس شورای اسلامی، ضمانت اجرا نیز تعیین شده است و هر مرجع قضایی كه بدون رعایت ترتیب این ماده رسیدگی نماید، مستوجب مجازات انتظامی از درجه پنج تا هفت معرفی شده است.

این تمهید به جهات متعددی با قانون اساسی مغایر است:

اولاً به سبب تبعیض بین آحاد مردم و نمایندگان مردم و ایجاد امتیاز برای ایشان مغایر بند 9 اصل 3 و اصول 19 و 20 قانون اساسی دایر بر برخورداری همه ملت ایران از حقوق مساوی و نظریه تفسیری شماره 80.21.3036 مورخ 1380.10.20 شورای نگهبان می‌باشد.

ثانیاً به سبب تكلیف مرجع قضایی به رعایت آن و تبعیت از نظریه هیات مذكور در قانون برخلاف اصل استقلال قاضی و مرجعیت دادگستری به رسیدگی به تظلمات و شكایات مقرر در اصل 159 است، چنانچه وفق صریح قسمت اخیر اصل 34 قانون اساسی هیچ كس را نمی‌توان از دادگاهی كه به موجب قانون حق مراجعه به آن را دارد، منع كرد.

شایان ذكر است در مورد وكلای دادگستری یا اطباء نیز رسیدگی انتظامی مانع رسیدگی در مرجع قضایی نمی‌باشد، لذا وضع چنین قاعده‌ای با سایر قوانین و مقررات ناظر بر مراجع رسیدگی به تخلفات صنفی و حرفه‌ای نیز هماهنگی ندارد.

به عبارت دیگر، با وضع این ماده و تبعیض های آن، درجه ای از مصونیت پارلمانی و تعلیق رسیدگی قضایی به رسیدگی در هیات مذكور در قانون پذیرفته شده است و از این جهت نیز با بند 1 نظریه تفسیری شورای نگهبان كه مستظهر به مشروح مذاكرات خبرگان قانون اساسی است، مغایر است .

ثالثاً وفق اصل 40 قانون اساسی هیچ كس نمی تواند اعمال حق خویش را وسیله اضرار به غیر یا تجاوز به منافع عمومی قرار دهد، لذا نمایندگان محترم مجلس شورای اسلامی برای اعمال حق آزادی خود در اظهار نظر و رای نمی توانند حقوق سایر اشخاص را از جمله حقوق مقرر در اصول 22، 23، 24 و 25 را مورد تعرض قرار دهند، چنانكه به درستی در بند 3 نظریه شورای نگهبان و نظر مبارك امام خمینی (ره) نیز بر پرهیز از هتك حرمت اشخاص و لزوم جبران در مجلس و رسیدگی در قوه قضاییه تاكید شده است.

روشن است كه وابسته نمودن این امر به رسیدگی در هیاتی از نمایندگان مجلس كه فاقد شرایط قاضی و داور اسلامی بوده و مظنه خروج از بیطرفی نیز ممكن به نظر می رسد، خلاف اصول مذكور است .

علاوه بر این، اعطای اختیار تعیین مصادیق به هیات مذكور در این قانون در ماهیت امر، منجر به تشخیص عنوان مجرمانه و غیر مجرمانه می گردد و تعیین جرم و مجازات طبق اصل 36 قانون اساسی و بوسیله قانون ممكن است و لذا واگذاری اختیار مذكور، اختیار اصل قانونگذاری به چند نفر از نمایندگان مجلس به جای مجلس شورای اسلامی و مغایر اصل 85 قانون اساسی است، خواهشمند است رسیدگی لازم معمول فرمایید.

به گزارش فارس، جمعی از مدیران و کارشناسان مراکز مطالعاتی و پژوهشی در روسیه و آسیای مرکزی با هدف بررسی زمینه‌های همکاری و آشنایی آنان با ایران و توانمندی‌های کشورمان در زمینه‌های مختلف از جمله علمی، فنی و رسانه‌ای و همچنین بازدید از برخی شهرها و پروژه های علمی و تخصصی به دعوت خبرگزاری فارس روز جمعه وارد تهران شدند.
